Welcome to iTravel eSIM, a service provided by IDM (“IDM”, “our”, “we”) that allows you (i.e. visitor, user, “you”, “your”, “yourself”) to access data while traveling abroad without the need for a physical SIM card (the “Services”). These terms and conditions (the “Terms”) are formulated in compliance with the applicable laws and outline the rules and regulations governing your access to our website and/or our application and/or your use of the iTravel eSIM Services. Please carefully review these Terms and be aware of the Services.
By accessing the website and/or the application and/or using the Services, you agree to abide by these Terms, without the need for a written signature. If you do not agree with all or any part of these Terms, please refrain from accessing the website and/or the application and/or using the Services.
By accessing the website and/or the application and all related sites and/or using the Services, you represent and warrant that you have the right, authority, and capacity to enter into the Terms and to abide by all the requirements described in these Terms.
These Terms shall constitute the legal binding agreement between IDM and yourself (accessing the website and/or the application and/or or using the Services) (the “Agreement”).
This introduction shall constitute an integral part of the Agreement.
iTravel eSIM is a prepaid service designed to facilitate data usage when traveling internationally. Through partnerships with third-party telecom providers, IDM offers seamless connectivity without the hassle of acquiring a traditional SIM card. To be able to use the Services, you shall activate an account as mentioned below in clause 6
To access iTravel eSIM, you must complete the registration process. By registering, you confirm your acceptance of these Terms and any additional rules and/or guidelines and/or any other terms and conditions provided by IDM.
Protecting your privacy is paramount to us. Our privacy policy (“Privacy Policy”) outlines how we collect, use, protect and disclose your personal information. By using iTravel eSIM, you acknowledge and agree to our Privacy Policy. For more details on how we collect, use, protect and disclose information, please refer to our Privacy Policy located www.itravelesim.com/privacy.
The intellectual property associated with iTravel eSIM and/or the Services and/or our website and/or application with all their content provides, including but not limited to trademarks, service marks, logos, software, and/or all proprietary rights are solely owned by IDM or its partners. You are not permitted to use or reproduce any of these materials without prior written authorization.
Your use of the Services and content is strictly limited to what is expressly authorized by IDM. Unauthorized use of the content available on our website and/or application may result in violations of copyright, trademark, and other applicable laws, potentially leading to criminal or civil penalties.
All distinctive graphics, icons, logos, service names, registered trademarks, unregistered trademarks, and/or service marks are owned by IDM. Any other trademarks or service marks belong to their respective owners. These Terms do not grant any rights to use trademarks, service marks, logos, or the name of iTravel eSIM and/or IDM.
You are solely responsible for all activities under your account, for protecting the confidentiality of your password, for prohibiting any other person or user to use your account, and for promptly notifying IDM of any unauthorized use of your account.
You understand and agree that IDM has the absolute right to reject, refuse, cancel, or remove you and/or any other person from our website or our application or from using the Services, with or without any reason, at any time, without any notice.
You understand and agree that by accessing our website or our application and/or by using the Services, you consent to the use of cookies by IDM in accordance with the terms of our Privacy Policy.
If the access to our website and/or to our application, and/or the use of the Services is against the laws of the place where you are accessing them and/or using them, we ask you not to use our website and/or our application and/or not to use our Services. You are responsible for informing yourself of and abiding by the laws and regulations of your jurisdiction.
IDM can terminate the Services at any time without any cause without the need of any notification or any other judicial formality.
IDM provides the iTravel eSIM service on an "as is" basis. IDM will make reasonable efforts to provide the you with quality Services. However, we do not guarantee uninterrupted, continuous, error free, timely delivered, safe Services. Any claim - pointing that Services’ features are missing and/or are not as supposed by you and/or do not match those provided by other similar services and/or competitors – is rejected. We also disclaim all representations and warranties of any kind, express or implied, including without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement, accuracy of information from third parties and resources. Downloading any content is done at your own risk, making you responsible for any damage to your device system or data loss that may result.
In no event will IDM or its representatives (including without limitation, its affiliates, subcontractors, assignees, employees, agents, consultants, directors, shareholders, managers, officers) be liable for any direct, indirect consequential, incidental, special, exemplary, punitive or enhanced damages (indirect damages), lost profits, revenues, data or use or diminution in value, investment, revenue, return, reputation, contract, production, opportunity, goodwill, data business, savings or goodwill, arising out of or relating to any breach of these Terms, and/or arising from the use or inability to use the Services and/or access to our website and/or application, regardless of whether such damages were foreseeable.
IDM reserves the right to modify these Terms or the iTravel eSIM Services from time to time without prior notice and without the need of your consent. This includes without limitation changes to features, functionality, pricing, and other aspects of the Services.
Your use of third-party resources while using iTravel eSIM is at your own risk. IDM is not responsible for the content or functionality of third-party services.
The failure of IDM to enforce any provision of these Terms does not constitute a waiver of that provision.
The omission of IDM to act regarding any breach of these Terms does not constitute a waiver of the right of IDM to act regarding subsequent similar breaches.
We shall not be held liable for any failure and/ or breach and/or delay in the execution of our obligations under these Terms if failure and/ or breach and/or delay are due to causes beyond our reasonable control, including but not limited to mechanical, electronic, or communication failures and/or breakdowns, degradation, hacker attacks, denial of service attacks, virus or other malicious software attacks or infections or power failures. If the event continues for more than 30 days, the Services will be terminated without the need of any notice or any judicial formality. All rights, obligations, including payment obligations, and liabilities incurred before termination remain in effect.
Data Consumption & Measurement
Data usage is measured in gigabytes (GB) or gibibytes (GiB), and any unused data expires with the plan, and no refunds will be provided.
Without prejudice to any other provision under these Terms, IDM reserves its right to suspend your use of the Services in case of your breach under this clause. This suspension does not affect any of your payment obligations under these Terms.
IDM reserves the right to modify pricing and coverage for the iTravel eSIM service at its discretion and without prior notice and without the need of your consent. Pricing and coverage may vary and are not guaranteed.
You agree to defend, hold harmless, and indemnify IDM from and against any and all claims, requests, demands, damages, costs and expenses, including attorney’s fees, arising from or related to your use of the Services and/or your access to the website and/or the application and/or your breach to any provision of these Terms.
If any provision of these Terms or part thereof is held to be void, illegal or unenforceable in any respect, that provision shall (so far as it is void, illegal or unenforceable) be given no effect and be deemed not to be included herein, and shall not affect or impair the validity, legality or enforceability of the other provisions of these Terms, all of which shall remain in full force and effect.
These terms are governed by Lebanese law, and any disputes will be subject to the jurisdiction of the Beirut Courts.
